    Is that the only document or have you got the original NTK that was issued on the 12th May?

          Hey Mike770 No i do not have NTK however i will have a hunt around and see if i can find it. if not do i need to write to countrywide for a copy. thanks winston

            If that is the first and only thing that you have received about this then we can go with that a dispute it. Can you remember receiving anything else?

              Hey Ostell This is all i have. The car was registered at my sister inlaws place. Ive been there today and no other mail. So they may have sent more however this is all i have at present . Thanks

                Ref PCN xxxxx VRM yyyyyy

                I am the registered keeper of the above vehicle and am in receipt of the PCN you issued. I have no liability on this matter as you have failed to meet the requirements of Schedule 4 of The Protection of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the prescribed relevant period of 14 days, contrary to section 9 (4) of the Act. You cannot therefore transfer liability from the driver at the time to me.

                There is no legal requirement to identify the driver at the time and I will not be doing so.

                Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

                      You've sent in the appeal, just sit and wait. There is nothing you can do. And they cannot just assume that you are the driver.


                      You could write back to them telling them that the 28 day limit for appeals is a purely a limit of their own invention.

                      There can be no assumption that the keeper was the driver and if they intend to use the case of Elliot v Loake as a precedent then this was a criminal case were forensic and other evidence showed that the keeper was the driver, there was no assumption. The applicability of this case in parking matters has been rejected by the courts many times.
