  • How to ensure repayment of debt with a charging order on jointly owned property

    I have been granted a CCJ to which no repayments have been made. I have decided to apply for a charging order against the debtors property. However it is a sole debtor and a jointly owned property.
    I have read all the information saying if awarded by the judge it will end up as a restriction on the register, and as a standard form K restriction it does not enforce the repayment of the debt.
    Also I have read that at the hearing you can ask for a non-standard restriction.

    1. Has anyone had experience and success with a similar situation - sole debtor, jointly owned property?

    2. Does anyone know how to word the non-standard restriction so that the debt has to repay the debt.

    Also worth noting the debtor is intending to sell their property and has listed it on the market.
