    OK - I will search for that argument within the forum thank you - is it too late to reply for that argument at this stage - do we go to court and explain it in person or via mediation ?

      It should really have gone in to your defence but if i goes to court then you may be able to slip it into the witness statement.

      Mediation will be they want the full amount, you want to pay nothing. No real arguments.

        Is there a page on the forum of how we deal with this next - do we fill in the form N180 to go straight to court and forget mediation - as you say could enter the witness statements but at what point - is it likely to follow a set course now

          On the form you select the court that is convenient for you, select if you want mediation (you've got nothing to lose, you could offer £5 to make it go away) No agreement in mediation then it will automatically proceed to court.

          Send a completed copy of the N180 to the court AND to the claimant at the same time.

          Your selected court will then allocate a time for the hearing and will tell you when all your documents have to be presented to the court,, usually, but not always, 14 days before the hearing. This is when you present your witness statement, a story of what happened and it gives you the chance to present the signs as evidence.

            I have spoken to the Hotel - They do not have dealings with the car parking company - lot's of people call them and they tell them the same.

            They lease the property from a Landowner from South Africa and he comes once a year to check it.

            They have lots of signs in and around the car park and it's down to the individual to register any vehicle at the reception desk - they have lot's of signs within the Hotel and they are very sorry but it's one of those things, we should just pay it as they 'the parking company' know what they are doing.

            I contacted Citizen Advice - no advice - unable to comment.

            I have searched high and low and got so much information from the web that is seems impossible to deal with this on my own - I'm out of my depth.

            The signs do not state that you have to register within the Hotel for every reason for being there, i.e. collecting or dropping someone off - they just state that you have to register for a parking permit Guest / Visitor.

            Feeling deflated -
