    Firstly thank you for allowing me to be part of Legal beagles.
    my question is, my wife and I have separated and she has sold the house we used to live in, the house is in here name as she had it prior to us marrying. I have been paying the mortgage for the last 8 years we agreed I would not take half the proceeds to which I believed I may be entitled to if she doesn’t go for half of my pension( when I retire).
    I have asked for £30,000 which is substantial y
    less than half. How do I stand legally please in obtaining the £30,000

    You will not be entitled to half the proceeds, you wife already had the house. If I was you I would walk away, keep your pension and count yourself lucky.

      How did you “agree” that you wouldn’t take half the sale proceeds if she didn’t go after your pension? Was it a formal agreement in writing etc?

      Are there any children involved?

      It may be best for you to talk to a solicitor who specialises in Family Law to establish whether you have/had a financial interest in the property since you paid the mortgage regardless of the fact your ex wife purchased it prior to your marriage.

      Ask them if you need to formalise your agreement because informal agreements can turn sour if one person meets a new partner in future despite your best intentions now.
