There are many reasons why a court might declare an agreement unenforceable. Would you care to provide more details?

I had a mortgage on a previous property. The property was sold with a shortfall and I was told an agreement would be made for the shortfall which never happened and the account was sold to another company who wave been very pushy in their recovery action. I have made a request for the credit agreement which the original lender said had been destroyed but I got a copy and have found this has not been signed by the lender.
