My Father in law passed away and my mother in law paid for the funeral with part funeral benefit. Nearly 4 months later she recieved nasty phone calls and letters and was requested to attend tribual at the age of 83 undergoing terminal cancer treatment. My MP has helped escalate through ICE and has been upheld and now the ombudsman decline!!!!!!

I'm sorry this isn't something I am familiar with either I'm afraid. I am assuming you have contacted your MP to instigate the ombudsman process. What form did your request take?
Was it a formal "subject access request" sent to the data protection Officer, or just a phone call to the local office wallah?

Did your MP raise the matter with the Parliamentary & Health Service Ombudsman ? (as per Peridot post 5)
Has there been a tribunal hearing?
I doubt in this case you could sue the DWP (or secretary of state) as there does not appear to have been any offence.
If the tribunal has found against your MiL I think your only course of action is for a judicial review that the decision is one which no reasonable decision maker could have come to.
Application needs to be made wihin 3 months of the Tribunal Finding..
