  • Unfair dismissal?

    I was finished from work about 1and half years ago for misconduct. I was breathalysed at work and was over the companies limit. I have recently been informed that another worker has basically done the same and was over the limit but has not been sacked. I was just wondering if I would have a case for unfair dismissal as it was the same misconduct but with different outcomes. I look forward to hearing from you soon. Thank you

    I am sorry to say that no you would not have any claim on the basis that you are out of time. Any claim to the tribunal needs to be made within 3 months of being dismissed.
