How do i apply to the Court about an agreement that is not enforceable.

Are you being taken to court by a creditor? or have you asked for your CCA agreement and the creditor can't produce it?

yeah, the Creditor won the case due to the fact that my defence did not comply with CPR Rules. I can not appeal it now, i have gone past the 21 day appeal time. I Can however bring a Claim under section 75 of the Credit Act, due to a breach of Section 56. The goods was very unsatisfactory quality, it was misrepresented by the Credit broker. The problem i am faced with is how can i make an application to the Court under 140 for the fact that the Creditor is demanding unreasonable documents to prove the breach even though i have supplied a straight forward comprehensive documents as proof, do i have to include the 140 plea in my statement or make an application with a form.

Secondly can i appeal the case after months of judgement? i guess my only reason is i could not afford representation. Will the Court allow me to appeal the case by myself now that i can defend the claim in its entirity
