    Hello

    I received a SJP from DVLA asking me to fill and send back - the offence was Unlicensed Vehicle for SORN car which was spotted on road. I pleaded guilty to this and sent back form to Swansea MC as advised.

    I phoned DVLA - there may be chance that I could cancel the Magistrate action if I pay their penalty and back tax. Obviously this is the ideal solution.

    In practice how does this work, time limits etc. I presume DVLA is prosecutor here, is that right, and that they can stop any prosecution? What is likely time frame for that?

    My worry is that I have already pleaded guilty through the post and sent to Swansea MC. I do not want to end up paying DVLA penalty and then being judged to pay court fine? Paying twice for the same offence.

    What will happen here?

    Very very anxious

      Did you not receive an out of court settlement letter first?

      You won't pay DVLA penalty AND court imposed fine.

        Thanks for your quick reply

        I cannot honestly remember an out of court settlement letter? I think I would have remembered something like that though.

        There has been no other violations for this car at all (always taxed, MoT and insured).

        Just worried that the 'System' might catch me twice here.

            Phoned DVLA this morning - paid their penalty £227. They also said that will withdraw the court action. And confirmation letter to be sent out showing payment. Then phoned Swansea MC - impressively enough the person told me they had just received an email from DVLA that it will be withdrawn.

            Will check again with magistrates later in week to once more confirm that this infact happened

            Nasty couple of weeks though this has been with this worry.
