  • Council tax liability order - letter template please

    Hi,
    On UC, have received a liability order for council tax. Citizen Advice say I should write to council to request minimum payment from my benefits. Does anyone have a template?

    Have you claimed Council Tax Support - (made a claim for Council Tax Support)?

    If you haven't already done so, then go onto your council website and make a claim because being on UC means that you are on a passported benefit and should therefore qualify for assistance with your council tax but only if you claim for it.

    If you still have a shortfall you could then apply for discretionary hardship payments. These would also apply to the housing element of your UC if you rent your property.

    As to the liability order, you will need to speak to your Council tax department who may or may not agree to a further payment plan. This would be at their discretion as when liability orders are applied for, claimants have usually defaulted on their payment scheme

      There are no templates as such.

      You just need to ask that they issue an attachment of benefit order under the Council Tax (Deductions from Income Support) Regulations 1993 (as amended) - this can only be done once a liability order has been issued, there are no powers to do so without the liability order. Any recovery route is at the discretion of your local authority.

        This may or may not be relevant here (it looks like it is). Page 3 of the document in the link below provides a table setting out how much the DWP can take from various benefits. Universal Credit is included.
