  • Excess Mileage Full Term?

    Hi Folks,

    Great web site. I recently came to the end of an agreement with VWFS which I ran till the very end due to not having any spare cash to buy another vehicle. Ideally I would of brought something else 5-6 months before the end of the agreement and then VT'd meaning I would not have to pay any excess mileage.

    There is loads of information on here and online regarding VT excess mileage but nothing if you went the full term.

    Few questions; Firstly I did pay over 50% of the value of the car, around £1000 over but went the full three years before handing it back. Is this definitely not classed as a VT? Secondly does this extra £1000 off set any excess mileage? If not why not? Thirdly if I do have to pay the excess mileage can I make them an offer on the figure or must it be the full figure? Finally if you out right don't pay it and just ignore it will they get bailiffs involved and will it effect your credit rating?

      Completing the term of the agreement is not the same as VT. The right to VT is by giving written notice before the final payment becomes due, as you've come to the end of the agreement this is one of those scenarios where you have no rights and are not entitled to the limited liability. I'm afraid you are liable and going to have to cough up unless you can come up with some other way out of it.

        Thanks Rob, I thought that would be the case.

        Can I make them an offer on the figure though? Does me overpaying on the 50% mark count towards it at all?

          paying more than 50% has no bearing in your case because the limited liability under section 100 is of no effect. The instalments are for the hire period and you've continued to use the car throughout the term and there's likely to be nothing within the terms and conditions which says your liability is limited, unless you VT - but feel free to check.

          By all means make an offer but from a legal point of view, they are well within their rights to recover the full amount.
