  • Subsequent notice of sums of arrears

    Dear all,

    Merry Christmas to all of you! Could one of you legal gurus explains to me in laymans terms what a "subsequent notice of sums in arrears" is and when are DCAs meant to issue one? I have received a letter from Link financial out of the blue for a credit card which hasn't been paid for since around 2013. I just wanted to understand the legal basis of them sending this notice.

      Hi I am guessing when you get six envelopes on the same day all providing a notice of sums in arrears for a different year. I had this recently for a loan which hasn't been paid for a while.

        The answer to your question is section 86 Consumer Credit Act 1974 > https://www.legislation.gov.uk/ukpga...39/section/86C

        If they don't comply then the debt may be unenforceable in court. This can be remedied so maybe that's what Link are attempting to do.

        If you haven't paid since 2013 (what exact date?) there's a possibility that the debt is heading towards Statute Barred status which is when debt purchasers and their DCAs tend to come out of the woodwork.

          Thanks all for the quick response! So shouldn't the original lender have sent me this notice ages ago rather than link financial years later? I will attach the letter for reference.
