    HI, i know my first post is not the best sounding but i have reasons to ask

    firstly i was a child when i was sentanced with this.
    Also i ve asd but i have managed to overcome the thrill of driving underage started when i was 14 ( as im now in my 30s).

    I had a dangerous driving with a extended test passed conviction in 2003 when i was 17. I am spent on my criminal past many years ago and have moved on with the lifestyle i used to live many years ago.

    I was sentanced in a mag court with this and the extended test was attached, from what i have been reading the extended test part is ONLY able to be attached in a crown court NOT a mag court.

    **************Is this factual information about mag court cannot attach this sentance and its a crown only sentance correct 2003 guidelines? *********************

    If its correct can i approach the sentencing court with this as a basis for an appeal out of time?

    Hi and welcome
    Why don't you just take the extended test?

    In any case my understanding is that currently if a dangerous driving case is heard in a magistrates court the max penalty is fine up to £5000, up to 6 months in prison and a minimum period of a year of mandatory disqualification with a compulsory extended retest before you can drive again.
    I think the mandatory disqualification and extended test have remained unchanged for years.

      In the crown court, the maximum penalty for dangerous driving is 2 years imprisonment, an unlimited fine and a minimum obligatory driving ban of 1 year. Before a full driving licence can be re-instated, the defendant will have to take an extended driving test.

      If the case is heard in the Magistrates Court, the maximum penalty for dangerous driving is 6 months imprisonment, a maximum fine of £5000 and a driving disqualification.


      This is what is baffling me, I have requested a FOI also, i wondered if anybody here would know about this,

        Looks like your info is correct, but not what I read elsewhere! and whether or not worth appealing after all this time I just wouldn't know

        Maximum when tried summarily: Level 5 fine and/or 6 months

        Maximum when tried on indictment: 2 years

        • Must endorse and disqualify for at least 12 months. Must order extended re-test

        • Must disqualify for at least 2 years if offender has had two or more disqualifications for periods of 56 days or more in preceding 3 years – refer to disqualification guidance and consult your legal adviser for further guidance


        If there is a delay in sentencing after conviction, consider interim disqualification
