    hi
    i received a claim form sent to me on the 22nd of nov from the County court business centre and im panicking and need some help.
    i had a mobile phone contract back in aug 2009 and contract got cancelled and it went into default on 25th april 2010 as i couldnt keep up the payments as i was going through a tough time and being on job seekers.
    The debt doesnt show on my credit report but was told by experian that it comes off automatically after 6 years.

    ill upload a copy of what theyve sent to me.

    what do i do? can someone help?

      yes ive acknoweledge the court claim on MCOL

      now i have 28 days from today to enter a defence

        Did you receive a formal Letter Before Claim, & if so, when was it dated?

          the letters comes to my parents address
          i pick them up weekly as i dont really live there
          but i dnt recall seeing a letter from lowell regarding this claim going to court.
          the claim form is the only one ive received

            You should have received loads.

            No matter.
            Firstly, send a CCA request to Lowell Portfolio, enclose a £1 fee (postal order is good).
            Secondly, a CPR 31.14 request to Lowell Solicitors, & ask for a copy of the agreement, all relevant terms & conditions, a copy of the Notice of Assignment, a copy of the Deed of Assignment, & a detailed breakdown of the alleged debt.
            Thirdly, send a Subject Access Request to Telefonica (£10 fee) for all data held by them, in any format, which is relevant to the agreement.
            Get proof of posting/sending for all communications from now on....& keep everything in writing.
