    Hi
    I wonder if anyone can help me again please Have had 1st credit chasing me since Jan 2017 for to debts with M@S
    one for £3073.25 personal reserve account and one for £1592.82 a charge card
    These 2 debts have been to numerous collection agencies BUt these have really gone for it on both accounts
    On 5/517 I was offered 50% off both accounts On the 19/9/17 A letter stating County Court Proceedings being considered on both accounts
    9/10/17 20% off both accounts then on 19/10/17 more letters headed Review for County Court Proceedings
    So on the 23/10/17 I sent 1st Credit a CCA letter for both the accounts and a SAR to M@S both letters signed for and received
    Today 11/11/17 I have had in the post off 1st credit a letter with a CCA agreement and pieces of paper stated as terms and conditions Also saying they await may settlement Have so far had nothing off M@S Flapping a bit now
    Help much appreciated as to what to do next Thanks for reading Accounts are not statues barred

    Added all paper work except CCA as don't know how to remove info

      Hi Copy the CCA blank out details and attach. Remove your name/address and the account details., it would be helpful if all the documents were separated and in order please.

        Hi Thanks for your reply I don't have a clue how to do any of the above sorry Amazed I even posted them up on here
        The first 2 letters are the covering letter off 1st Credit and the next 2 are the T@C for the account have the CCA which on closer look says it a application form ??

          Really and truly without the CCA it is difficult to comment

          When was the last payment made on either of these accounts, I ask because one set of terms and conditions was 1996 and the other 2005.

          Maybe [MENTION=87380]Diana M[/MENTION] could offer some advice or if you are worried maybe get some free initial legal advice - her email is in her signature and she works for a specialist consumer credit solicitor

              I have received your PM

              The SAR should tell you when the account was defaulted but actually I am surprised 1st Credit didn't mention it in their letter - maybe they do not know- that would be fun if they tried to issue a claim!

                SAR was sent to M@S on 23/10/17 and signed for by them on 25/10/17 heard nothing off them yet The court threats have been may issue or are thinking of maybe issuing court proceedings also had offer of 50% off the debt Thank you for your help

                  I have been looking at the terms and conditions and am wondering how 1st Credit are distinguishing the two different accounts.

                  I know you say one was a charge card but could it have been converted to a credit card at some point - if so I think you have a good defence there , lets just say Santander v Mayhew ( btw Diana M is the Mayhew in that case)

                  The other, probably more important question is the nature of these letters from 1st Credit , have any of them said they are a letter of claim or letter before action or do they just consist of various may, might, consider court action. It is quite possible they know they have not got a chance but I can't really give advice without knowing all the facts

                  I know you are waiting for the SAR but do you have any idea when the last payments were made to either account to anyone ?

                    Hi again the 2 sets of T@C are for the one account (haven't had anything for the other account yet) which is saying its a charge card but it was a store card ?? 1st Credit have sent no letter of claim or letter of action everything is may maybe etc I am not sure of last payment was paying M@S £1 per month stopped that around 2012 so I know its statue barred in 2018 Don't now when I defaulted the account I sent a CCA request because I was being sent letters every 10days and phone calls and 2 court threats

                              Hi warwick65 Have searched everywhere for when this account (charge card) was defaulted it certainly wasn't 2005 much later on paperwork I have here (still no reply to SAR off M@S) I had help with my debts many years ago and was paying M@S a £1 a month on each account but stopped it when it was getting past to many debt collectors Having searched this site for days to try and make head or tail of what they have sent am I right in thinking that the T@C are incorrect ?? and do I just sit it out for SAR off M@S Thank you for your time
