  • The law relating to timeshare

    Hi
I wonder if any one can advise me regarding the law on timeshare?

18 years ago my wife and I bought a timeshare in Tenerife through a third party, this was a two week share in a resort in Silencio, named Tenerife Sunclub, which we visited and enjoyed for a number of years until the apartments dilapidated and devalued, the sale also included a one week share in a Resort Club in Malta, which we only ever visited once. We did how ever maintain the management fees on both timeshares for many years. This sadly came to an end as the properties at the Tenerife Sunclub became unviable and the club were offering timeshares for ridiculous prices and we decided to terminate, aware that we were under contract, we offered The Tenerife Sunclub and The Sunny Coast Resort Club two years management fees to terminate, The Tenerife Sunclub accepted and we parted amicably, how ever The Sunny Coast Resort Club did not, this was around seven years ago. We received threatening letters from debt collectors for a couple of years written to my wife as it was in her name, we ignored them as we did not feel it was with them that we had the contract as it was bought with The Tenerife Sunclub purchase.

The letters stopped after we moved house five years ago. How ever my wife recently received a ACCOUNT OVERDUE NOTIFICATION for the sum of £2,620.00 for outstanding management fees from an organisation called Network Credit Services which say's it is a trading name of Quinn's Limited, registered at 4 Barrack Street, Hamilton, ML3 0DG.

Does any one know where the law stand with this? can this be enforced in a court of Law?

My wife is understandably becoming stressed with this and has also started to receive phone calls but we need to know where we stand before we take any action.

    Thank you.
