    Hi All
    I am Executor of an estate. The main beneficiary has no fixed address, she lives in a temporary B&B, or sofa surfs. She has a criminal record for Theft from shops, assault, prostitution, and has a drug using habit.
    Legal advice from friends who have been Executors before, is to pay legacy by cheque, because this leaves a record, therefore no receipt is needed (beneficiary is unwilling to sign anything).
    As she has no fixed address, how can I send a cheque? Should I ask her to employ a solicitor at her own expense, just for purpose of receiving her envelope with a cheque from me ?

      but as you seem to have some sort of contact by arrangement by hand as per paula above

        How big is this legacy? Is it a life changing amount? If it is then perhaps a trust fundo to provide "extra comforts" might be the way to go . If it is made discretionary then the government won't be able to count it as capital.

          hello, thank you for your replies. I will look at the idea of using a process server.
          I cannot meet the beneficiary face to face as I am sorry to say it is a violent bullying sort of person. I have reported their behaviour to the police.

          a trust fund - would be a good idea except that I am not willing to act as a trustee, and employing a solicitor would consume the funds. also my understanding of discretionary trust is that it is to benefit a class of people so the beneficiary would never agree, as wants her money.

          i am looking into the idea of appointing a solicitor to help me distribute.
