    Given so many are now coming back to haunt people, should we be advising people to send the SB letter as soon as they know for sure it is SB to the creditor at that time, in order to try to pre-empt any potential action later on?

    I don't know how these claims are doing in court, but if they were all failing, I assume the DCA's would stop issuing the claims.

      Statute Barred debt and letters regarding the status of them.

      A useful way of indicating the status of a debt and the consequences of that status should be made clear a personal " favourite" is

      " The alleged debt is stature barred, therefore I will not make any payment or offer of payment now or in the future".
      I would remind xxxxx DCA/creditor of the regulators guidance on the sale of statute barred debt Without Informing the purchaser of the status of the debt".

      Using this I have found cuts down considerably the chance of resurrection of SB debts.
