            me already got it matty the penny dropped as soona s i posted ffs................i should know better as i did a large project on human rights and the right to a fair trial for my A level law..........................................:o .and got 76% for it..........my law tutor would hang her head in shame:o

                  have thought about this all weekend! this obviously makes me obsessed! But this has made me so angry! and i totally agree that this is against our human rights, not to be able to, LAWFULLY, get back, UNLAWFUL charges! where on earth is the justice in this! the OFT, and the Banks already know what the outcome of this will be, this whole court case is just for public viewing! Or am I being paranoid!

                    Useful Info re OFT/Ongoing Claims

                    Have just spoken to Natwest who have told me that in the light of the OFT case, any claims received before 24th July will proceed as normal, anything after this date will not.

                    I clarified by asking whether this meant that if a Prelim had been received before 24th July, and was told that it did. So I take this to mean that if we've asked for the charges back before this date, we should be okay. The girl I was speaking to said that yes, this was the case.

                          They are definitley paying up if an offer letter has already been received. Mine still hasn't hit my bank account but girl I spoke to says its definitley going through, 7 - 14 working days etc...I'm expecting it any day soon- need to get Collections off my back!

                            Any rule regarding the non-processing of active claims does not rest with the banks but with the courts. The Master of the Rolls has apparently been asked to agree to this, but until such time as the courts have received a directive, claims should continue as normal. Even then I hope that we will be appealing any stay and making life as difficult as possible for both the banks and the courts (if they agree to this one-sided and unjust arrangement).

                            If banks are telling people this, then they are already lying to customers about the process, when it hasn't even been agreed, in order to stop people proceeding (I would like to have this in writing!) and we need to counter this.

                            If it is true its good news for me because I have just sent NatWest a prelim for my 14 year business claim, using Tools new 6+ POC. This was received by them on 21st. I already have this POC filed with Yorks for a personal account, with the 28 days ending on 8 August. It will be good to be able to test it on both personal and business accounts.

                            I suspect that given the developments, they will not want to make waves about the last claims if they are forced to process them. This could give us very useful ammunition for later on...

                              Well got my reply from FD, says my complaint appears to be about bank charges!!

                              The its 1 1/2 pages explaining to me that the OFT have an agreement with them and 6 other banks to settle the lawfulness of the charges, how the FSA have waived their complaints procedure and how they'll get back to me when the matter is settled.

                              Thanks for that FD.

                              I feel another letter coming on........

                                Has anybody considered if the banks are going to try to get +6 year charges and Contractual Interest excluded from all future claims via the test case, is there any opportunity/chance they could do this?
