What is the exact course the banks would have to take to go to the House of Lords and also what timescales would be involved
Thanks

Appeals from (i) High Court of Justice in England (if that's where it's being held... been away for a while) & Wales; and (ii) High Court of Justice in Northern Ireland
1.12 In certain cases, and subject to certain conditions, an appeal lies direct from the High Court in England and Wales or in Northern Ireland to the House of Lords. A certificate of the High Court must first be obtained and the leave of the House of Lords then sought and given before the appeal may proceed (see direction 6)12. No application may be made to the House of Lords without the certificate of the High Court.
(12) direction 6 of the Administration of Justice Act 1969 ss 12-15
OR maybe this.... (just to confuse matters)
Appeals from (i) the Court of Appeal in England & Wales; and (ii) the Court of Appeal in Northern Ireland
1.5 An appeal to the House of Lords from any order or judgment of the Court of Appeal in England and Wales or in Northern Ireland may only be brought with the leave of the Court of Appeal or of the House of Lords3.
1.6 An application for leave to appeal must be made first to the Court of Appeal and only after that Court refuses leave may application be made to the House of Lords4 itself. Application is made by presenting a petition for leave to appeal5.
(3) Administration of Justice (Appeals) Act 1934 s 1(1)
(4) This does not apply to applications for leave to cross-appeal where an Appeal Committee has given leave to appeal in the original appeal: direction 30.1
(5) form of petition
... found it here hope it helps somewhatLast edited by thephoenix; 27th October 2008, 21:23:PM.

Re: Appeal
Having all but given up on ever meeting the elusive Kate Farrow, the attentions of my heart are now firmly focussed on Sarah Love who, along with Gemima Stratford, Richard Coleman and Jonathon Crowe, make up the OFT's in-court legal team.
She has an elf like silhouette, wears no make up, has lovely eyes and looks irresistably fetching in her silks and wig. Frankly she's all I ever look at in court.
I've googled her to death but alas failed to find a photo of her. If anyone can come up with one, I'd be eternally grateful.

PMSL
I am gonna write a book, the life and loves of Exc!
After public rejection by Megan Murphy ( FT Court Correspondant ), possibly due to his referring to Megan's court attire as an "old pair of cargo pants and a gardening sweater" which led to Megan declaring on her facebook page that "she didnt actually own a gardening sweater" the scourge of the High Court has now switched his attentions to Sarah Love of the OFT's Legal team.
What are Exc's prospects here you might ask?
Probably not that great actually.
His suggestion that the new love of his life has features resembling an elf, wears a wig and cannot be bothered with make up is perhaps not ideal way to capture her heart.
She is a cracker though !!!

Re: Appeal
Is anyone looking at the trades descriptions act argument over misrepresentation? If applicable, it looks like it could provide an even stronger argument than penalties on historic claims anyway. I know its not being looked at in the test case, but it could possibly help those embarking on new claims which include historic charges/T&Cs.
Basically, they say charges were to cover costs. The PCA report emphatically disproves this claim, therefore the terms are deliberately misrepresented to the consumer.
Trade Descriptions Act 1968 (c.29)
See S.13 & S.14, I'm just not 100% sure if this can apply because it talks about services. However, the account as a whole is a service in which certain terms have been deliberately misrepresented with a view to a profit..
