Christopher Graham told the home affairs select committee that his powers relate to the data protection act and "blagging" information.
He was appearing before the committee as part of their inquiry into phone hacking.
Graham said that regulation of investigatory powers act, passed in 2000, is out of date, while the data protection act only carries a maximum penalty of a fine of up to £5,000 and no option to send people to prison........
