    Hi my car June 2008 1.5 auto scenic dynamite had done 15.685 miles and was in pristine condition with FSH
    It was parked in a bay, unoccupied on a high st.
    It was hit by a driver not paying attn.
    The car is now a cat C write off. Non fault.
    I have been offered £3k for the car and salvage buyback is £370.
    I had just lost my parter on holiday. I was repatriated with him, this happened the day after.
    I now have no income as he was the breadwinner.
    It has caused me so much upset as I was given a massive 7 seater as a courtesy car. I couldn't drive it and waited 7 days for a smaller replacement. I had funerals etc to arrange.
    I cannot find another car in the same condition and mileage for £3k. The Insurance refuse to up the offer. I found some which were more expensive with the same reg but higher mileage. They won't accept that as they said they found some cheaper. The garage where the car is said they are ripping me off.
    Where do I stand legally please.

      Who are your insurers? Have you checked any of the terms and conditions in relation to payment of a car in the event of a write off?
      Have you also asked them how they have calculated the amount being £3,000 and what evidence do they have to support this?

      I'm assuming the car is a Renault Scenic? Can't seem to find that particular model on any valuation sites to work out whether their offer is reasonable or not. Do you mean the trim of the car is dynamic, not dynamite?

      How bad is the damage? Are you looking to take the money given your circumstances instead of having the car back?

        Which insurance company has offered the settlement, your own or the third parties?
        If your own can you please give us a link to the policy wording.?
        And yours or third parties, could you please name them?

          The Renault Scenic was 1598 cc VVT A
          I insure with Admiral multi car policy.
          The other driver insured with the Coop.
          I was referred to Albany Assistance by Admiral
          As the other driver admitted fault.
          I don't have the policy details it is at my late partners workplace.

            Ithe car is cat C the estimated cost is over 6k to repair. The Chasis moved forward 15mm and the Xle has bent. The gearbox interior housing has been pushed upward.
            I feel 3k is low for FSH and such low mileage. The garage said its like a new car. They offered to buy the salvage from me prior to the offer. The owner would have put it back on the road himself as its exceptionally clean.
            They said £370 is excessive to buy back, and 3k is low.
            I asked Admiral to review their first offer. They refuse to up it.
            They won't look at my service history or at other cars I have found priced higher.
            I just want a fair price.

                    You have two options:
                    1) sue Admiral for breach of contract.
                    You comprehensive policy undertakes to fully indemnify you for loss of your vehicle.
                    Their policy wording makes it clear that it will be the market value.
                    Market value is the market where YOU THE INSURED buys
                    "The cost of replacing your car, with one of a similar make, model,year, mileage and condition based on market prices at the timeof the loss. Use of the term ‘market’ in which you would normallyshop for your car ....."
                    The insurers are failing to perform the contract.
                    Did they say were they found these cheaper veicles?

                    2) sue the third party for the shortfall (or even your full losses if you have not yet accepted your insurer's offer)


                    If it was I, I would be going after Admiral (with or without their b****y telescope)!

                        The quote is from THEIR policy wording.
                        Glasses guide is rarely used nowadays as a guide to indemnity values.
