    I have an ongoing PPI claim with Scarlet Services where I paid £358 by credit card upfront for them to claim on my behalf, however they have taken over 18 months and keep fobbing me off and tell me they won't pay back the no win no fee charge until it's closed which THEY won't do. If I close the case I forfeit the fees. They are rubbish and I have had no end of trouble. My question is: can I claim this from my bank under section 75 ?

    In order to make a sec 75 claim you'd need to prove breech of contract.

    Their terms & conditions are a bit ambiguous on the upfront payment but the FAQs indicate that they should have concluded the services in 'several months' and that you shouldn't end up any worse off by using their services.

    Do you know the status of the PPI claim? ie is it with the Financial Ombudsman? If not then you can argue that they haven't provided you the service within the time that they indicated.
