  • Cabot once again I need help on

    Back in October 2013 I asked for help with Cabot. They where chasing me for a debt from jd Williams. To cut a very long story short, I had a couple of accounts back in 2006/2007 that went into debt. To my knowledge these where paid to lowells and another debt agency. Then out of the blue Cabot applied for the debts again. After a lot of help on here I sent cca to McWilliams with no response. Then sent my pounds with copies to cca section 77/78 to Cabot. Nothing came back in the 14 days, so then sent the next bit no reply in the 30 days. So this morning get letters from them again saying please find enclosed relevant info following my request, enclosed reconstituted true copy with the consumer credit agreement,which with for the avoidance of doubt complies with consumer credit regs 1984 so complies with obligation set out in section 77/78. They say as they have complied with request which I signed they will endorse CCjs.
    There is no signature on these copies, just my name written on them.
    also a copy of a letter from jdw 6/October 2014 that I never received saying account opened 29/October 2007 they do not need to send signed copy and all correspondence should be with Cabot.
    what the devil do I do now please
    help. Sorry if this makes no sense, I'm panicking as these are for over £1000 and I have already paid way over this to other debt companies. Really don't no what to do I can't afford to pay again. Both the copies they have sent of agreement are exactly the same same writing on them so look like they have just been printed off and written on by them, not original .

    Any chance you could remove your personal details and post up the alleged 'true' copies? :typing:

    Endorse CCJs? I don't know what that means, it takes a lot more than an 'endorsement' to obtain a CCJ, they would have to issue a claim which you would have the opportunity to defend.

    How long ago did you default on this account? Have you been making payments for this debt or are you referring to other accounts?

      Hi, I have bank statements from 2009 and 2010 paid to jd Williams and scotcall, which 2 years ago I sent copies to Cabot and jd but Cabot say these are different accounts . And as I have no paperwork from 2006/2007 because of dodgy divorce I have no proff. Cabot started this 2 years ago. Sorry I can't scan there letters I'm afraid .

        I'm sorry flaming parrot. I have calmed down a bit now. I now have 3 letters from them for 3 different accounts, totalling about £1300. The exact wording is: please find enclosed all relevant information following your request for information under sec77-78 of cca1974 we can confirm that we have provided a reconstituted true copy of credit agreement which for the avoidance of doubt complies with cc regs 1983 and there fore complies with the obligation set out in 77-78 of cca. As we now complied with your request we are able to enforce this credit agreement which you signed and entered into. Enforcement means that we are able to obtain a county court judgment against you. But would prefer to work to set up a payment I have photographed the true copies they have sent, but not sure how to post them on here. I sent the section 77-78 to them at least 18/20 months ago.           It would be if it's a reconstituted copy, it would have been taken from their own files. You wouldn't have signed the recons, you wouldn't have had them before you sent the requests. The main thing is to see whether they are valid recons, i.e. honest and accurate reconstructions of your agreement.

                  Is that all that's been provided, it seems a bit short on terms and conditions??
                  How was this described as " your agreement" a " reconstituted" agreement?

                    Hi this is a reconstituted form, they have sent 3 separate ones, but all exactly the same sorry there are some terms and conditions on the back of form shall I try and copy them for you. I'm really struggling with this as I have already paid so much to different dca for this. But they just wont stop asking.

                        No don't do any more, this recon may comply with a CCA request, enforceability would be
                        down to a judge to decide.
                        Question are these T's & C's those actually relevant to the company that you had an account
                        with I have seen JDW T's & C's supplied with a request made for another company in the group.

                            I know you think it is an account from 2006 or 2007 but is there anything within the CCA requests that identifies exactly when the agreement was taken out?

                            Have you moved since the agreement was taken out and if so which address is on the recon, I know when i asked for agreements for my late wife they sent them all with her new address on, luckily I knew when they had been opened and where she had lived at the time so they got diddly squat

                              Hi Jon 1965' yes I have moved a couple of times, but the recon they sent has the old address on it, where it was taken out, but no dates on anything. The biggest problem is my name has changed, some of the debt companies used my maiden name some used my old married name, which has now changed again. So when paying different debt comp they have diff names. I have already paid over £1300 to diff comps, but when I tried to speak to jdw and sort this out they just say no they can't help as it's been passed on, and Cabot just say they no nothing of this and these are diff accounts! This is just ruining my life, I just think it's over then 20 months on it pops up again, I don't no what to do next! Apart from pay them again, but feel I should,not have to.
