  • PCN at Warwick Motorway Services

    Hi, I’ve received a PCN for overstaying at Warwick Services on the M40. I parked in the main forecourt for 2 hours but I had to make some more telephone calls so I moved my car out of the main car park to an available space at the petrol station which is in a different area. I don’t remember seeing any parking notices in this area but I’m not 100% sure. Any grounds for appealing this please?

              Appealing to ParkingEye is of no avail

              As expected that notice is compliant with the provisions of PoFA2012.

              This will leave two possible ways to dispute the court claim that will come your way if you don't pay their demands.

              The first will centre round what is probably in the small font at the bottom of their signs. it is to do with extra unspecified charges that may be levied to enforce payment. We would need to see the wording on the sign.

              The other argument will centre round PE's wording that the driver exceeded the time in the car park.
              I believe the cameras actually recorded the time entering and exiting the whole site. (but you will need to check that .. perhaps the photos help0
              Does anywhere describe the whole site as the car park?
              You would need to ague in court that the signs refer to parking in an area which a reasonable person would regard as the car park, and that time spent outside of that area eg in the filling station is not time spent in the car park
              So recording the time spent on site does not truly reflect the time parking in the car park

              Whether or not you could do that successfully I couldn't say
