    I purchased a new build house a year ago and I was given a £6000 choices voucher, when I recieved my closing statement this had been deducted from the amount I owed, I queried this at the time and my solicitor checked with the housing developers solicitors and both confirmed this was correct that it was a deduction, I have this in an email and also on a voicemail. I then recieved my closing statement in the post which again had the £6000 deduction so this shows they accepted this is correct. Since then I have recieved emails advising that this was an error on their part and I need to pay the £6000 back, it has now been a year since I purchased the property and I have been sent a letter before action and a revised closing statement with the £6000 as owed, can they do this a year on from the event and after sending the original closing statement?
    Any advice would be greatly appreciated.

    If they made a mistake in figure owed FOS and FCA will back lender check prior cases . If you spent the voucher and they then deducted from total amount that would mean they have you 12k effectively rather than 6k voucher for presumably fittings fixture asthetics. They may also say as you question ed it you were aware.

    Why has it only came to light now? Effectively they will stand that you know amount to be repaid circa any interest charges et al ald that 6k was specific and not to be deducted.

    I would still complain though they have left it a year and they may at least reduce the figure as goodwill.

    It depends on the company whether they will accept their mistake or hold you to the lilt which they can do.

    No point in asking for CCA as will show original agreed repayments but a sdars do request to show how you questioned deduction and response is ask data subject request

      Mate, I think you don't need to pay anything 'cause it was their fault in the first place. I would recommend you to ask specialists to finally solve this problem. As far as I know closing statement is not a legal document, so I don't know why they are still bothering you. I think you need to seek the assistance of a broker to finally solve this problem. And something tells me that they won't just leave you alone after that. I think that you'll need Mortgage Broker Leeds in the near to help you with such situations.
