csa help please

  • csa help please

    My husband has been hit with the csa he pays her when the kids need things that was ok then we got married the boy go to boading school due to haveing a t h d she gets income spo 2x disabled money at the top rate 4x child benefits has she has shown us she gets £500 PW IN benefits she only has the kids in the summer hoildays why do we have to pay her so much we have been told to pay up £300pm she phoned us and said haha im now going to get £800 pw we can only pay £100 pm but the csa dont care we are going to lose the place we rent and our jobs we need help we only get £1100pm she will get £3200pm its not fair

      It's irrelevant what she gets to be honest. If you think that the amount is too high then you can ask the CSA to review that amount due to the fact that his income is not sufficient to cover his bills.
      The link below shows how Child Maintenance is worked out. Get him to check that the amount he pays is correct. BTW, according to my calculations she gets over £40k a year.......(the government are planning to cap the amount so she might be laughing now but she will not for much longer).

        We have and its £51pw we have told them thay have looked in to our money and still say the same she needs the money tolook after the kids but she only sees them 6weeks ayear which thay no about I have just been told she wont get the £300 from us it gos to the csa which then stops it out of her money

          If the calculator says you pay £51 a week then that is how much you should pay based on that calculator. The figure should be based solely on his income alone. Have you appealed the decision?

              I have to say if anyone has kids,do they expect NOT to pay for them if their earning they can pay why should the taxpayer have to pay>If the sums involved seem to be to much the CSA will decide what should be paid having read the CSA website there is a basic calculator thats sets out what is expected to be paid.

                There seems to be a lot of anecdotal evidence which suggests that this is as a result of 'soft' targets & target-driven policy.

                  I have never understood why CSA is worked out on net salary and not in proportion to your "disposable income". My partner pays £170 per month to his ex, if he was single (i.e. not living with me) he would be left with less than £200 per month when rent, CT, utilities were paid, and considering that his son now "lives" with us 3 out of 4 weekends and it costs us £50 fuel each weekend to pick him up as we live in Kent and he lives in Essex ... my OH would starve! I don't condone in any way non-resident parents not paying for their children, but I can understand why some try to get out of it. If it wasn't for the fact that I work, and my salary is not taken into account, we wouldn't be able to afford to live.

                    As Leclerc says in post 3, you can appeal and the link he gives there will tell you the various grounds and how to do so. You don’t, for example, say whether or how often the children stay with you and your husband – that would make a difference. You also might possibly be entitled to other benefits yourselves.

                    To add perspective - DLA is awarded to the disabled person for their individual benefit, so whilst your husband’s ex may receive it on their behalf, as appointee, it’s not hers to spend other than for the benefit of the disabled children themselves.

                    Additionally, if they are in residential care, the “care” component (£79.15 each @ the highest rate) is only payable pro rata when they are away from their residential school (eg at home with their mother)although the mobility component (£55.25 higher rate) is payable all year round.

                    If I’ve understood you correctly, this means that from the £500pw, c.£270 belongs to the children themselves (or £110 odd of £340 when they are away at school).

                    I think you may be the subject of a wind-up, because £300pm does not make £500pw jump to £800pw – it’s £575 odd (less is you take off the £160 DLA not payable whilst they are in residential school).

                    The mother seems, from your post (you say 4 x CB), to have 2 other children, which presumably attract additional benefits.

                    Your husband’s 2 children must have very severe disabilities to get DLA at the highest rates and to obtain funding for specialist residential school; I doubt that their mother’s life is a cake-walk. I can see why you might feel it’s unfair but I hope the above helps the financial angle to make more sense. It would hardly be viable to bring up 2 children with severe disabilities on £75 (£37.50each) per week, let alone £25 (£12.50 each), so her contribution, financially as well as in other areas, will be considerable.

                    I don’t understand why you say you will “lose your jobs” because of this payment?
