    Just to confirm that after a little uncertainty the hearing will be going ahead as originally scheduled and in the format as per my post #148 on Wednesday 29 October.

    We hope to be giving updates from the hearing throughout the day.

    Excellent, at least a certain amount of expediency, and if it goes Olis way,we may even hear the judgment by Xmas!

    Though even if that's won, I take it Lloyds will move it to the Supreme Court - what's a few £M in fees when you're facing a potential bill of £Bn 's?

    Just an update on this:

    It's a rolled-up hearing where permission is considered at 10.30 and if granted, the appeal takes place immediately after although the court may switch judges.

    Apparently it's not unusual to have the whole thing thrashed out and then at the end the judge decides a) whether to grant permission to appeal and b) if he does, decide on whether the appeal succeeds. This is what happened at the BBA v FSA Judicial Review.

    Any judgment on the appeal is expected to be reserved.

    What was TB's argument to RBS against the "Paid" argument?

    Hope this doesn't sink it before it has chance, checked through some of my statements and I have a minimum of 4k (plus interest) one account alone!

    It will be interesting to see if the Bank attempt to throw out the case on the basis that payment has been made to Orfoster and that effectively the case is closed.....
