Re: BBC News Allows Retail Expert to Encourage Consumers to Commit Fraud

War & Peace, again, as usual.

The original point was regarding returning pre-sale items to shops, not to on-line retailers where DSR applies, so again another red herring.

Re: BBC News Allows Retail Expert to Encourage Consumers to Commit Fraud

For gods sake. Am talking about High street retailers not online retailers. My reference to online retail was purely regarding my own interest in retail. And its likely they purchase the pre-sales item on the high street, or online, more than 7 days prior to purchasing the same item in the sale from the same retailer.

By the way, online retailers do not have to accept returned goods that have had labels removed, or returned without their original packaging either as the buyer would in breach of his duty to take reasonable care of the items, which includes the items packaging. Though returned items where the item packaging has been opened by the seller for inspection must be accepted if the request to cancel is made within 7 days starting from the date after the date the item is delivered. If the request is made after 7 days then there is no difference between online retailers and High Street retailers when it comes to accepting returns.

Though where certain media items are concerned they can only be returned if still in their original plastic wrapper and/or the seal is unbroken, regardless of distance selling rules. Unless of course the item is faulty when opened. In fact all of the following are excluded from the distance selling regulations for online sales: newspapers, magazines, personalised goods, flowers, food, software where the seal is broken, clothes that have been worn other than just to try them on, hotel bookings, and transport tickets. Such exaceptions are granted under regulation 13!!

Sorry exc, but i was merely explaining just how little difference there is between online retailers and high street retailers, in regards to similar circumstances concerning the condition of returned goods and the condition of their packaging/labels. And pointing out the distance selling regulations do not apply to all goods, where seals have been broken or have been worn (other to trying them on) etc. Something most consumers fail to realise, and the amount of time i have been threatened with legal action, trading standards etc because the consumer believes the cancellation period applies regardless of type of goods, or condition of the goods and or their/packaging is unbelievable. Ignorance doesn't make the customer right!

This thread itself is actually about high street retailers in general not online retailers. Given Its mainly high street retailers that hold Sales this time of year, as majority of online retailers already sell at prices equivalent to sales prices all year round. Also most people would not return an item bought online in order to buy the same item in at sales price, as they will likely have the postage cost to pay for returning the item, subject to the retailers terms and conditions. So they would probably not save much, or anything at all on the majority of goods purchased online, if they followed this retail experts advice when it comes to online purchases.
