    I have found out whilst applying for a job I have a CCJ against me. Looking into it I discovered this is due to a vehicle I once owned had not been taxed, despite me not owning the vehicle at the time, I sold the vehicle in 2005. I have phoned the DVLA and have discovered this vehicle is still in my name, and the CCJ had been issued to me for non payment of car tax of Sept 2006 and CCJ was issued March 2007. I had no idea of this as I had moved from the address the DVLA had on file in June 2006.
    I have tracked down the owner and he is happy to testify that he owned the vehicle in this period, however the DVLA are stating that it is my duty to make sure the vehicle had been correctly transferred over.
    Is there any way I can get this CCJ removed/ erased from my credit report, as this is threatening my job. This is so frustrating as I have been very careful with money and feel the system has let me down and my career is on the line, unless I get this CCJ removed quickly.

    A CCJ may be set aside for a number of reasons, one of which is failure of service, for example if the defendant was not living at the address at which the documents were served. If the judgment is set aside, the CCJ is taken off the Register of Judgments, Orders and Fines unless or until a new judgment is made.

    However, it may not be as easy as this, since the onus is on the seller to inform the DVLA of the change of ownership. Failure to do this means the seller will continue to be responsible for paying the car’s road tax as well as any penalties for non-payment of it.

    There is a great deal wrong with this story. For example, it is an offence not to tell the DVLA of a change of address for which one can be fined up to £1000, how come the OP moved four years ago yet the DVLA don't know?

    If he wants to stir up a hornets' nest he could inform the DVLA that the new owner will swear an affidavit that he owned the car at the time if was not taxed, but in doing so, he will admit to a number of other offences. He'd be better off explaining the situation to his new employers and avoiding dealing with the DVLA altogether.

    The system has not let him down, he has been stupid and for several years.

      hi, i have a very similar problem. i am originally from northern ireland, however, in 2007 i was living and working in london for a retail company. i decided to return to northern ireland after 4 months of employment as i was feeling home sick. after returning from london i recieved the last wages payment into my bank account. it was a bit larger than expected but i put this down to holiday entitlement. about a month ago i applied for credit and was rejected. i checked my credit rating on experian and it says that i have a ccj from the afformentioned company. this is the first time i even knew that they have been looking for money from me and im assuming that this was the reason. what can i do to solve/get around this. the company knew i was leaving the country to return to ireland as it was my reason for notice.the also knew my address as they had done a 'working reffernce'with my past employers but have failed to send me any notice of court actions for 3 years!! what can i do as the credit i was looking to achieve was a mortgage.
