  • Can a trustee of a discretionary trust benefit as a trustee?

Quoting a solicitor: "The trustees distributed the estate, including to themselves as trustees of the will trust" sounds wrong to me. I mean, a trustee by nature looks after the trust and a beneficiary benefits. My understanding is that once they start dishing money out to themselves, they are classed as beneficiaries not trustees.

It depends on the terms of the trust, but if the trustees were professional trustees it is usual for them to be remunerated.
