  • Is probate needed

    Hi
My mother passed away and left a will .i am the sole executor dealing with it all .my mum had a total value of money in the bank of £42.000 .to be shared equally between all 4 of us .2 sons and 2 daughters. She lived in a static caravan that's very old and is only value is £7000 to scrap it .The park owners have already paid the £7000 so they can scrap it and put a new on there plot of land .The park owners have already stated in a contract no out standing bills are due .ie water and electricity. I just got o pay final gas bill .I have registered mums death with all the goverment departments and will pay any due bills etc .The bank has already closed mums account and transferred all the monies to a account I have opened just for this .She didn't own a car or any other property. All her furniture has been donated to charities. My question is do I need to apply for probate .even when I can just pay all due bills and any claims due in the future .I want to distribute the funds equally to all 4 of us as stated in the will minus any bills .Any advice would be great if probate is needed.i will be doing it my self .Ps the park owners who bought mums home to scrap did not ask for any probate forms etc

For small estates like this Probate often isn't needed. The people who might insist on it would be banks and financial instituions who held your mother's money. Each has its own rules about when they will require Probate before releasing funds. But it sounds like bank did not require it and all funds have been released to you and are now under your control. In which case you don't need Probate to administer and distribute the estate.
