    Hi!
    I’ve just joined here today and read a few threads. Long story short, my brother was made the executor but we had the solicitors doing all the legal work for probate and the solicitors were the party that submitted probate.
    Probate granted August 2025 and inheritance distributed.
    Me and my brother are estranged but I had received a message from my sister that the DWP had sent him a letter
    , no info what they said.
    But my question is, when I spoke to the solicitors they had no letter from the DWP but are finding out what the situation is.
    Im not sure if the DWP sent my brother a letter, would the solicitors who submitted probate be notified also?

    If your brother is the sole executor named in the Will and in the grant of probate then DWP would write to him because the executor is the person who is legally responsible for the distribution of the estate, not the solicitors. The solicitors have no formal role if they weren't appointed as executors and were only carrying out work for your brother. Once probate is granted it becomes a public document that DWP can look up online and see who the executor is.

    Without knowing what the letter says it's impossible to comment further.

        My guess - and I might be wrong - is that the DWP has written to the executor about either an overpayment or underpayment of money.
        Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.
