Couple died. Child in charge. Maintains silence to beneficiaries.

  • Couple died. Child in charge. Maintains silence to beneficiaries.

    New query from deaths in England in 2024.
    Any help would be appreciated.

    Wife died (no will apparently) on 28th of month. Husband died (with new will) on 20th the very next month.

    Husband's new will made on 6th of the month he died. (Therefore, the new will, done by a solicitor, and signed 8 days after wife's death).

    Administrator and Executor in both cases is the couples only child together. Husband has several other children included those that predecessor him.

    Issue is... none of husband's children from the other relationships have heard or received any information. Some are named in his old and new will, and are due to get percentage shares of what is left (after funeral costs have to be taken from their share). The Husband's Executor has probate, sold the house and still remains silent to the Husband's children.

    Any suggestions on way forward please?

    Have you seen the Will? You can obtain a copy from the Probate Registry.

      Yes, the new Will for Husband is in hand that's how we see some of his children as beneficiaries.

      "I GIVE all the remainder of my estate (out of which shall be paid my funeral and testamentary expenses and my debts) and any property over which I have over at my death any general power of appointment to be divided as:"

      It goes on.. 1/3rd to child who is Executor and 2/3rds split in percentages to others including 3 of Husband's own children.

      His own children believe they should get something from the house that was sold as well as anythjng else.

        Is the issue here that some people are disputing the Will or that they have seen the Will and know they are beneficiaries but the Executor is giving them no information about when they can expect to be paid their legacy?

          It's a case of nothing from the Executor who has cut off any dissenters to her ways. Silence.

          I told some of the beneficiaries to get accounts, do a LvN to the solicitor who prepared the new Will and be prepared to pay a lawyer to help them as no one knows the £money or assets in the estate

            No one is disputing Will except to say the Executor takes the lion's share.
