  • Probate and HMRC error

    My mum passed 6 or so weeks ago and a solicitor is applying for probate grant only with me dealing with the other bits. I've just had cheque sent from HMRC which is a PAYE tax refund for my mum but the cheque has MRS in front of my name instead of MR it has the correct initial and surname for me though.I looked at the letter that came with it and that says MRS too they know I'm the representative for my mum as it mentions that just the wrong title for me,I then looked at another letter they sent a week before and the same thing,I hadn't noticed at the time.
    I do wonder how this occurred though,I think it's possible to be the solicitor when they have been doing probate,as part of their remit for the scope of work for probate it says they prepare any necessary HM Revenue and Custom account in support of the application of grant.I haven't asked them about this yet due to the cost of sending solicitor e mails but this sounds as if that HMRC account has been set up wrongly with me being called a MRS instead of a MR as I assume a section of those forms will ask who the rep/executor is and that was input wrong on that part could this throw a spanner in the works for probate being done properly as surely everything needs to be technically correct.
    The solicitor sounds like the person who could sort it out it's to do with the account that's been set up or would it be better to ring the tax office myself?
    I'm really worried about this.
    Maybe I'm over worrying an the wrong title in front of the correct initial and same surname isn't a big deal but I'm going to be stuck paying that cheque in

    HMRC has a bereavement helpline which you could telephone to discuss your mum's tax affairs

    Did you use the government service "Tell Us Once" to report your mum's death stating yourself as the next of kin?

    Does your mum's first name start with the same letter as your first name?

      You might ask HMRC to issue a replacement cheque with the payee corrected.

        Hi Pezza54 I did use the tell us once service and no mum's initial is different to mine on the letter it says Mrs Mark Wilson as personal representative of Mrs Anne Wilson

          Hi atticus Yes I think i will have to with regards the cheque somebody said to me try and stick it in your account with a bank self serve machine and tried to convince me titles in front of names don't matter but that worried me and I don't want to do that.I hope it's all easy for me to sort out.I don't think the solicitor has sent off for probate yet I received a draft of the figures from them for the estate that they are about to submit and signed it and took to them on Friday

              Hi no the letter with the cheque came in the afternoon after I had taken the paperwork to the solicitor is that going to be a big problem I'm the sole beneficiary of the estate.I hope they haven't sent off the forms then that I have only just approved,that's bad timing as it looks like more time for me to pay their fees to adjust the figures again.
              I hope HMRC don't ask me to send in the copy of the renunciation and will that I had replaced the staples on to prove who I am with regards to the wrong title on the cheque and letters.the solicitor has the original copies of those documents that she's sending off for probate

                Phone or email the solicitor. He or she may not be too concerned and say that the forms don't need amending at the present time

                Before phoning HMRC you could speak to your bank's customer services and ask them if it matters that a cheque is made payable to your full name but has an incorrect title
