Outstanding Interim Accounts

    As I’m not receiving any information regarding the current state of my mothers estate including interim accounts or interim payments I presume that my next steps would be to contact the lawyers appointed by my sister to carry out executor duties giving them a timeframe (14 or 21 days?) to respond ?

    what would be the best way to approach this and what sort of wording would be appropriate to try and get a reasonable response?

      This is sounding rather circular. Isn't this where we started in Post #1? You had asked for the interim accounts and the solicitor wouldn't provide them?

      If you are going to give a 14 or 21 day deadline what are you going to do if they don't supply the accounts in that period? No point setting deadlines unless you know your next step if the deadline isn't met.

      Have you applied for an Inventory and Accounts Order?

        At present I have not applied for an inventory and accounts order.

        This will form part of my response to the solicitors to get some action from them but I need to set a deadline or my letter will just be ignored.

          So I submitted a letter of intent to the solicitors, who promptly apologised and provided the interim accounts 1 month out of date.

          Having skimmed through the executors list of expenses (£14k) there are certainly a few contentious items included (PlayStation and online games) along with the removal of my mother’s jewelry which was apparently gifted, but certainly not included within the last will or any previous.

          although I fell that I have a duty of care to question some of the activities of my sibling, ultimately am I wasting my time, and delaying the inevitable ? I am only entitled to 1/3 of any adjusted figure .

          Has anyone else been through this process and can offer some advice?

            So on closer inspection I have discovered that my mother incurred a CCJ which was uncontested before she passed. My sister has been contesting this CCJ and has now doubled the debt in legal fees. I did warn the solicitors at an early stage about avoiding a vexatious claim as it would be pointless and a waste of money and something that I (as a beneficiary) would not support.
            i have raised this with the solicitors and awaiting their response…
            thoughts people?

              How much is the debt for?
              Did your solicitor or the executor send a copy of the death certificate to the creditor?

                From my understanding, the debt £10k was approved by court before my mother passed. The last day for appeal was the day she died.
                As only a beneficiary, I do not know what further legal exchanges have occurred but surely those solicitors have a duty of care where vexatious cases are concerned?
                I have written again asking what the plan is going forward as you can’t have these matters outstanding against an estate indefinitely. The interim accounts show a set aside £1,200 for further potential legals.
