    How is an intestate estate divided?
    My wife has been contacted by a comercal company saying she may inherit part of an estate. We are waiting for probate to show up on the probate registry to establish the solicitor dealing with the estate.
    The deceased relative had no children, grandchildren, siblings or surviving parents.
    The relative had 8 aunts & uncles now deceased. 7 of these Aunts & Uncles had differing numbers of children - cousins of the deceased.
    Some of the cousins have died but have surviving children.
    Is the estate divided into 7 equal 'Aunts & Uncles' portions & each portion then divided equally by cousins or children of the cousins
    Or is the estate divided equally by the number of cousins?

    Under the rules of intestacy if the deceased has no living spouse or civil partner, no children, no grandchildren, no surviving parents or never had any siblings, but has or had aunts and uncles, then the estate is divided equally between the aunts and uncles. If any aunts or uncles died before the deceased then their share passes in equal amounts to their children (cousins of the deceased)

    The above assumes the deceased lived in England or Wales

      If an Aunt had 2 children but 1 child is deceased with surviving children would I be correct in saying the deceased’s children would inherit their share
