  • Applying for Probate: Is do nothing a sensible option

If you have read my previous posts you will have the background (thank you for all the advice and support on my personal woe)

At times like this when faced with increaasing levels of litigation and threats to call in the lawyers, the best decision is to do nothing and not return fire? In these situations there are no true winners unless you count the size of the solicitor's bill?

I spoke with a specialist lawyer. They quoted £4k just to go over the case, review correspondences and come up with options for legal recourse. In the letter of engagement they also anticipated high court action in the region of £100k. with a reasoable chance of success and vindication - will it be a pyrhic victory?

The default is to argue black is white and they know nothing other than the fight, without considering the the emotional of financial consequence.

I have decided to get off the carousel, but I will make sure I have carried out my fiduciary duties. IHT, pay any debts and then suggest all siblings become admins; so jointly responsible; any decision will need all of our approval/sign-off. It will probably mean a stalemate becasue they struggle getting an agreement without it turning in to mistrust and infighting. Fire off an angry email, or send a solicitors letter.

Four siblings can apply to become administrators. All applicants should apply on a single form PA1A
You need to stop your solicitor applying to make you sole administrator, if it isn't too late

It does sound like your heading for the perfect storm

Thank you Pezza54 i have contacted probate lawyer and await an update but I think it is not too late. I am resigned to things moving at a glacially slow pace, the only way to guarantee no one BF gets to hold the purse strings.
