    Step Father did not apply for probate when my mother died in October 2023, then produced a wil, reluctantly that left everything to him. Seven months before this so called 'Will' my mother wanted me present when she left her half of their shared home in Trust, for my brother and I after his death. 7 months later, they married as mum was disabled, and needing much care, possibly residential. They married for financial reasons and her husband changed the will, a TRUST that lasted 30 days. She could not communicate effecrively, and relied on him for everything. It is so not possible that the most loving mother, who lived for her children and grandchildren would do this willingly. He did not apply for probate.

    I am sorry to read this.

    The marriage will itself have revoked previous wills - s18 Wills Act 1837. Without a new will, intestacy rules would apply, meaning that your stepfather would receive a sizeable statutory legacy.

    You do not say anything about your mother's estate. The terms on which the "shared home" was owned will be significant, as it is possible that your stepfather automatically became sole owner on your mother's death: this needs to be investigated.

    You may need to consult a solicitor.
