    If you are benificary joint tenants of a fully paid up property and two executors are refusing to sign probate and it will be a year since the lady died in a week , can the Solicitor sign it plus the other executor is the other joint tenant and partner of the deceased?

    When a property is held as beneficial joint tenants and one tenant dies, ownership of the property automatically passes to the surviving tenant under the rules of survivorship
    Probate is normally not required.
    The surviving tenant/executor should contact a solicitor and provide the death certificate so the solicitor can arrange for the name of the deceased tenant to be removed at the Land Registry
