I applied for probate on the 25th of April 2023, on the 29th of January 2024 a Caveat was placed on my probate, I entered a warning towards Caveator, I struggled to serve as his correspondence address letters were being refused eventually I posted it through the letter box, he did nothing for 2 weeks I finally got the caveat removed by a statement of service. I contacted probate who advised me that the caveator has also applied to probate but for letters of admin, as he doesn’t have the will and isn’t named as the executor nor has he disputed me as the executor, so I entered a caveat against his and no warning has been sealed on that as yet, as I’ve been told that no further caveat can be entered against mine or so I was led to believe by probate themselves, on the 8th of April I took the then caveator to court over theft and interMeddling with the estate, the Judge directed that we are to get an expert to examine said will as he is disputing the signature, I was to choose 3 companies for him to pick one which I’ve done, he also stated in court that the car he stole off of a private drive that was in the process of being bequeathed to someone else have a bequeathed bill of transfer and receipt for that, was sold to him by my dad on the 18th of March 2023 when they ate at a pub, now my dad the testator was a very private man he would not have sold his car in a pub, my dad also told me 3 days before he died that he would never get rid of the car in question he loved it and I guess he was holding on to it being bequeathed to the rightful person, he passed away on the 6th of April 2023 my mother found him, the then caveator has yet provided me with his defence pack and the Receipt, I have since issued into court sufficient evidence to have his defence and the receipt struck out hopefully hear soon , he was told the car must not be touched until a decision has been made which likely won’t happen until the court hearing in September however he has since broke into the vehicle as I have both the original keys, got an mot, tax and insurance on it, likely removed possessions that was inside which belongs to my mother including disability aids, he has now entered a further caveat against my probate I’m just at a loss, I’ve got a company to run but can’t run it as I need probate to access the documents to have the business signed over to the residual beneficiary so as it stands there’s a loss of earnings which I’ve been told I can sue him for, he was told not to do anything regarding the car as until the receipt is proven valid it’s technically held by court until decision is made on whether the Will I know is legally valid as I have already asked solicitors to check it before I applied for probate, so my question is what can I do next to shut him down for good legally I don’t mean a meat cleaver to the head as tempting as that is I want to be legal to show who the better person is. Also I need a solicitor who can verify a will, contact a finance company on my behalf to stop the business from going under so any recommendations can and will be very helpful.
