Probate and in what order?

    Legal advice regarding the situation. What I have been told is I will need to apply for probate separately for my mother and father. It doesn’t matter in what order.

    They are essentially independent and separate cases, as my mother didn’t claim for my fathers estate and can’t now.

    I will apply for my father first to allow the property to transferred out of his name.

    And then apply for my mothers probate to deal with bank accounts.

      Clearly your mother can't claim anything now, However, the administrator appointed to manage her estate could.
      For IHT purposes your father's property passed to your mother, she didn't have to make a claim at the time.
      You are going to need a solicitor so why not consult one before applying for probate.
