  • Grant of Probate Timing Enquiry - your advice would be greatly appreciated.

My father died in early April last year and the Probate application was finally submitted on the 5/1/24.

Please could you advise us on an approximate length of time for the grant of Probate to be issued, and thereafter for the subsequent phases of the process, especially when the chattels can be formally (legally) disposed of and when my late father's property can be put on the market (minus the chattels as the current clutter is likely to diminish the sale value).

Online applications are taking 12-16 weeks, we are told, and paper more like 9 months.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

The Executors don't have to wait for Probate to start clearing the house and getting it ready for sale but they won't be able to complete sale without Probate in practice because purchasers will insist vendor has Probate to prove their legal right to sell.
