    Hello, what happens if a caveator dies after a caveat has been made permanent (warning and appearance were entered) but no further action made in the dispute? Would the executor of their estate continue the dispute on their behalf?

    That is possible. But at this stage and on this information nothing can be said with any certainty. It is likely to be the executor who makes his or her decision.

    You might consider applying to the court for directions.

      Okay, thanks. This situation has not occurred. I was just curious whether a caveat continues to exist if the caveator passes away or whether the caveat would be removed upon death (or the executor of the deceased would take over).
