  • Permanent caveat time limit

    Hello, in a Will dispute when a caveat is warned and an appearance made (thus making it permanent), if no progress is made by either side for many years, will the probate registry eventually contact both sides to encourage a resolution or is there no time limit on a permanent caveat? Thank you.

    No time limit. The caveat remains in place until probate action is commenced or parties agree to the discontinuance of the caveat.

      Thanks for confirming. This is good to know.

      If we are not pressured to deal with this now then we are going to leave it until the inheritance being disputed (currently in a trust) is due to be released (upon the passing of the life tenant). This could be in 10 plus years though. That is when the caveator is due to receive his money, but his own caveat will stop that going through. Perhaps then he will be more interested in wanting to resolve matters
