    My cousin died, his parents predeceased him, he was unmarried and no children.. he had an aunt and an uncle who were both siblings of his mum... his uncle had 2 children and his aunt 3 children,,, both uncle / aunt long dead,,, the cousins will secure the estate, is it paus out equally or is it paid out 50% to the uncles 2 kids and 50% to the aunts 3 kids???this is a scottish case

    Assuming father had no siblings.

    Because each benificiary is at the same level of relationship, distribution is 'per capita'. Each will receive an equal amount.
