  • Executor requests

    Good evening

Firstly thanks for reading this and I do hope you can share some light.

I am due to inherit some money from a family estate.

The executor (who is a family member, although that relationship isnt the best) is asking to see 'certified proof of my true identity (passport or driving license) and proof of residency and bank details. The communication has all been via email.

Does this sound normal? Why would a family member need to see sensitive documentation and is doing this via email safe?

    I look forward to replies

If you are worried about email, send documents, bank details etc by registered post.

This executor is seeking to cover his backside.

Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf

Bank details needed so he/she can do a bank transfer to you, so any Executor would need that.

I've never asked for proof of ID as an Executor distributing to family members and it's not a legal requirement. But Executor is entitled to ask for it although wanting copies to be certified seems exessively cautious.

The Executor is covering themself to make sure he/she is paying the beneficiary named in the Will. If the Executor did pay the wrong person he/she could be personally liable for the mistake.
