land taken by neighbour

elderly neighbour shortened his long garden by 12 foot in order to manage - his neighbour started to use it without asking him ever and he has never said anything although when he was going to chop some trees down in it he was told Not to -
Question is should this elderly neighbour get something in writing to say he has never consented, nor sold, given away, leased the land and it remains his - or could his neighbour claim it if he has been using it for a few years. Should he have something put on his deeds?

Landowner should either put a stop to it or get something very clear in writing. He would do well to take legal advice.

He risks losing this land through adverse possession.
