  • Mum's passed

Hi all mum passed 2 days ago and we are looking for her will.
I have a couple questions that are keeping me awake at night and I feel like I'm going insane thinking about them.
My mum was with her partner for 15 years and never got married, I like him and do trust him but I cannot het it out my head that he seems to have control over her accounts, he says they have all joint accounts.
She also had a house which was left to her and she sold it just before she died and was waiting for it to be finalised. I know she wanted the proceeds of that house to go to my brother and myself but I cannot stop thinking I have no control.over anything.
could someone give me.some advice cos i cannot sleep and its driving me insane, i dont particularly want anyone to know i feel like this cos it seems I'm a money grabber but I honestly am not, i just feel not in control of anything at the moment.

To an extent your are correct. You do not have control. The way this works out is already written. These issues were decided, properly, by your mother in the way she managed her affairs, and the way she held her various accounts.

Firstly, sorry for your loss, a tough time, things will get better.

Are you sure there is a will? (If there isn't one, the rules of intestacy apply),

Have you checked with her solicitor?

Is it likely to be the solicitor that handled the sale of the house?

      Good guidance below:

Thanks for the replies. I have one more question. If they arnt married does that make my brother and myself 'next of kin' or does this again depend if it says anything in the will.

If there is a 'valid Will', that will dictate to whom the assets go. If there isn't a Will, then Intestacy Rules apply..

Sorry, I was being cryptic. All the answers are on paperwork which now exists. If there is a will, then that will ststaes what will happen. If there is no will then the estate will pass as intestate.
You and your brother may be next of kin, or not.
