  • Will Trust and Beneficiary question

    I am doing some estate planning as I have a terminal illness. I am the beneficiary of a Will Trust which will probably come to an end and be 'distributable' sometime after I pass. Am I right in thinking that my share of the Will Trust will just revert back into the other beneficiaries? Or is there anything that I can do so that I can pass on my the share of the Will Trust to my estate.

    That will depend on the terms of the trust.

    This sounds like a case in which you should be taking professional advice.

      Thank you for replying. Will definitely get some advice. There was no stipulation about how this scenario should be handled in the will that created the Will Trust so I'm assuming a 'default' stance was taken when the trust was created...

          You have no share until the will comes into effect - on the death of the testator.
